CCS Issues Proposed Infringement Decision Against Motor Vehicle Traders

  1. The Competition Commission of Singapore (CCS) has today issued a Proposed Infringement Decision (PID) against 13 motor vehicle traders for contravening Section 34 of the Competition Act (Cap.50B) (the “Act”), by engaging in an anti-competitive agreement to suppress bids at public auctions of motor vehicles.

  2. The infringing conduct in this PID involves bid-rigging through an agreement to suppress bids at these auctions, which has the object of preventing, restricting or distorting competition, and is a breach of the Act.

  3. The PID is a written notice setting out the basis for CCS’ decision. It is issued to the parties concerned, to give them an opportunity to submit their arguments to CCS, and provide any other information for consideration, before CCS finalises its decision on whether there has been an infringement. 

  4. All the parties have until 18 October 2012 to make such representations. Kindly refer to the Annex for the list of the 13 motor vehicle traders.
